The Supreme Court has chimed in on an activist lower court judge’s decision to force the Trump Administration to “facilitate” the re-entry of an ILLEGAL ALIEN back into the United States!
Kilmar Alejandro Abrego Garcia an ILLEGAL ALIEN from El Salvador was deported to El Salvador and is being held there at the (now famous) El Salvadoran CECOT prison.
I get it, he was inadvertently labeled as a gang member and deported under the Alien Enemies Act, but is he, or is he not an ILLEGAL ALIEN? Is he, as an El Salvadoran, not back in his NATIVE El Salvador?
I get it, release him, but do not “facilitate” his entry back into the United States! He will have his freedom back in his native country if you simply release him right there in El Salvador.
However, the Trump Administration is being told to “facilitate” his return back to the United States. Do you know where else that word FACILITATE is used? It is used in the Immigration and Nationality Act (INA) under a criminal statute (8 USC 1324). The statute states that anyone transporting, harboring, FACILITATING (aiding) the entry of ILLEGAL ALIENS into the United States is in violation of this FELONY!
So unelected judges are telling the Chief Executive Law Enforcement Officer of the United States to violate written law passed by the legislative branch at the behest of “we the people!”
Okay, I’m willing to acknowledge that even illegal aliens have a right to due process under our Constitution. Set up a video conference and let him plead his case before an Immigration Judge. I can assure you that El Salvador under President Bukele is not a country that presents a credible fear claim for Abrego Garcia.
Even if there was a credible fear claim, he should have gone to Honduras or even Guatemala to make that claim. Instead, he crossed through three countries illegally before crossing ILLEGALLY into the United States. The fact that he didn’t go to the nearest contiguous country to make this claim and the fact that he crossed illegally into the United States (violation of 8 USC 1325) makes him deportable!
The fact that unelected judges are forcing the United States to FACILITATE the illegal re-entry of an ILLEGAL ALIEN is criminal. Are we not a nation of laws?
